These terms govern the contract between you and FaraServ for game servers, virtual servers and dedicated servers. They are written to be read once, in plain language, with the statutory references named where they apply.
These terms apply to every order placed on this site. The contracting party, its legal form and its register entry are named in the imprint; where an entry is still pending, the imprint says so instead of showing a placeholder.
Deviating terms of the customer do not become part of the contract unless we accept them in writing.
Your order is an offer. The contract takes effect when we confirm it or provision the service, whichever happens first.
The scope of the service is what the product page, the configurator and this document describe at the time of the order. Features listed as included are not removed during a running term.
A contract runs for the billing period you chose and renews for the same period unless it is cancelled before the current term ends. Cancellation happens in the panel, without a form and without a retention call.
We may terminate for good cause, in particular for non-payment after a reminder, or for a breach of the acceptable use policy.
The price is the one shown at the time of the order. On the Persian site prices are in Toman and include value added tax; here they are in euro and VAT is added at checkout according to your billing country.
If an invoice goes unpaid we send a reminder and set a deadline before suspending the service. Data is kept for the grace period described in the refund and privacy documents.
You are responsible for the content you host, for the security of your credentials, and for keeping your own copy of anything you cannot afford to lose. The acceptable use policy forms part of this contract.
Access data may not be handed to third parties outside your own organisation. Sub-user accounts with scoped permissions exist for exactly that purpose.
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and wherever liability is mandatory by law. For slight negligence we are liable only for breach of a material contractual obligation, and only for the foreseeable damage typical of this kind of contract.
The service level agreement defines the remedy for missed availability. It is the primary remedy and it is applied without you having to ask for it.
Material changes are announced by email to the account address at least 30 days before they take effect. If you do not accept them, you may terminate as of the date they take effect.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, the mandatory consumer protection rules of their country of residence remain unaffected.
Contracts concluded through the Persian arm are governed by Iranian law and are handled by the Iranian partner entity named in that site's legal pages.
Support forwards anything legal to the people who wrote it, and answers in writing.
